In summary :
- If the duty of vigilance has been the subject of much attention for several years, it remains a simple obligation of means, difficult to sanction in practice, despite the possibility for associations to initiate civil actions.
- However, the sanction exists, because reputational risk constitutes a very effective vector of compliance. For vigilance, the reputational lever precedes the legal one.
